These Terms govern your use of Mark. Plain language, no surprises, the same care we put into the app.

These Terms of Use ("Terms") govern your use of the Mark app ("Mark," "the app," "we," "us"), published by northOS. By downloading or using Mark, you agree to these Terms. If you don't agree, please don't use the app.

01the app and your license

We grant you a personal, non-exclusive, non-transferable, revocable license to use Mark on Apple devices you own or control, in accordance with these Terms and the App Store Terms of Service.

02Apple's standard license terms (EULA)

Your use of Mark is also subject to Apple's Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and Apple's standard EULA conflict on app-licensing matters, Apple's EULA governs to the extent required.

03Mark Premium (subscriptions)

Mark is free to use for its core daily features. Mark Premium is an optional auto-renewing subscription that unlocks additional depth (such as your full all-time history and insights, premium card designs, and richer moment attachments).

If and when subscriptions are offered, the following terms apply:

  • Free vs. paid. Core capture, marking, private journaling, recent history, and branded sharing remain free. Premium unlocks additional features described on the purchase screen.
  • Billing. Payment is charged to your Apple ID at confirmation of purchase.
  • Auto-renewal. Subscriptions automatically renew at the then-current price for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
  • Pricing. Subscription options and prices are shown in the app before purchase. Founding subscribers who join during the founding window are charged $49/year and keep that price for as long as their subscription remains active; standard pricing thereafter is higher (shown at purchase). A monthly option may also be offered.
  • Managing and cancelling. You can manage or cancel your subscription anytime in App Store → your Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period.
  • Refunds. Purchases are handled by Apple; refund requests are subject to Apple's policies, not ours.
  • Free trials/offers (if any) automatically convert to a paid subscription unless cancelled before the trial ends.

The current, authoritative price and terms for any subscription are always those shown to you on the App Store purchase screen.

04your content is yours

Anything you create in Mark — your notes, photos, moods, and history — belongs to you. We claim no ownership of it, and (as described in our Privacy Policy) we don't store it on our servers. You are responsible for the content you create and for anything you choose to share.

05sharing and branding

Mark lets you share branded recap cards. These cards include Mark branding and a link to the app, on both free and paid tiers. You agree not to remove, alter, or obscure that branding.

06acceptable use

You agree not to misuse the app, including: reverse-engineering it except as permitted by law; using it to violate any law; or attempting to disrupt or compromise it or other users.

07not health or medical advice

Mark is a personal habit and journaling tool for general well-being and reflection. It is not a medical device and does not provide medical, psychological, or health advice. Don't rely on it for any medical decision; consult a qualified professional for health concerns.

08disclaimers

Mark is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We don't warrant that the app will be uninterrupted, error-free, or that data sync (which depends on Apple iCloud) will always be available.

09limitation of liability

To the fullest extent permitted by law, northOS will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of the app. Because your data lives on your own device and iCloud, please maintain your own backups (e.g., keep iCloud enabled).

10changes

We may update the app and these Terms over time. Material changes to these Terms will be reflected by the "Last updated" date, and continued use after changes means you accept them.

11termination

You may stop using Mark at any time by deleting it. We may suspend or end the license if you materially breach these Terms.

12governing law

These Terms are governed by the laws of Québec, Canada, without regard to conflict-of-law rules.
